majeunesse.app (“we,” “us,” or “MAJEUNESSE.APP”) provides a web-based CRM platform for daycare services, enabling efficient management of operations, including enrollment, billing, parent communication, and the production of documents such as R24 slips. This Privacy Policy explains how we process personal information as a data processor under Quebec’s Act to modernize legislative provisions respecting the protection of personal information (Loi 25) and, for Canadian clients outside Quebec, the Personal Information Protection and Electronic Documents Act (PIPEDA). We are committed to protecting the privacy of the data we process on behalf of daycare services (the “employers”).

2. Collection of Personal Information

We do not directly collect personal information from the clients (parents, children, or other contacts) of daycare services. This data is collected by the employers, who use our platform to manage it. The categories of personal information processed include:

  • Children: Name, address, admission date, date of birth, allergies, health conditions, photo.
  • Parents: Name, address, social insurance number (for R24 slips), email address, phone numbers.
  • Other Contacts: Name, address, phone number of authorized pick-up persons (e.g., grandparents) and emergency contacts.
  • Employees: Name, address, email address, phone number, general health information (e.g., allergies).
  • Employment Information: Salary, worked hours, qualifications.

No biometric data or formal health records are collected.

3. Purposes of Data Processing

Personal information is processed solely per the employers’ instructions for the following purposes:

  • Managing daycare operations (enrollment, billing, planning, waiting lists).
  • Communicating with parents via email, notifications, or SMS.
  • Generating reports and documents, including R24 slips for government purposes.
  • Managing attendance (child check-in/check-out).
  • Conducting surveys with parents.
  • Transmitting data to government authorities, as required.

4. Consent

Employers are responsible for obtaining explicit consent from parents (or legal guardians for children under 14) before collecting, using, or disclosing their personal information. Consent is collected through online registration forms on our platform. Parents have read-only access to their information via a secure portal, allowing them to review their data.

5. Data Security

We implement appropriate technical and organizational measures to protect personal information, including:

  • Encryption of data in transit and at rest (e.g., HTTPS).
  • Role-based access controls.
  • Firewalls and regular security audits.

All personal information is hosted on dedicated servers located in Montreal, Quebec. Third-party services, such as SendGrid (used for emails and notifications), process data only per our instructions and do not access personal data for other purposes. No other third parties access personal data.

6. Confidentiality Incidents

In the event of a confidentiality incident (e.g., unauthorized access, loss, or disclosure of data), we commit to:

  • Detecting and assessing the incident promptly.
  • Notifying the affected employer immediately so they can inform the Commission d’accès à l’information du Québec (CAI) and affected individuals, as required by Loi 25.
  • Taking corrective measures to mitigate harm and prevent future incidents.

7. Data Subject Rights

Under Loi 25 and PIPEDA, parents, legal guardians, and daycare employees have the following rights regarding their personal information:

  • Access: Request a copy of their data.
  • Rectification: Correct inaccurate or incomplete data.
  • Portability: Receive their data in a structured, commonly used format.
  • Deletion: Request the deletion of their data, subject to legal retention obligations.

8. Data Transfers

All personal information is hosted on servers in Montreal, Quebec, and no transfers outside Quebec occur. For daycare services in Ontario, New Brunswick, or Albania, we ensure data is protected in accordance with PIPEDA (Canada) and general data protection principles for Albania, while remaining hosted in Quebec.

9. Protection of Minors’ Data

Data relating to children under 14 is particularly sensitive. Employers must obtain parental consent through online registration forms before collecting such data. Our platform facilitates the documentation and management of these consents.

10. Data Retention and Destruction

Personal information is retained only for the duration necessary for the employers’ purposes or legal obligations. Data from deactivated daycare profiles is securely deleted after a 180-day grace period. Employers are responsible for downloading or saving pertinent data (e.g., R24 slips) before this period ends. A copy of R24 slips is provided to employers for retention, if needed.

11. Changes to the Policy

We may update this policy at any time. Changes take effect upon posting on our site. Your continued use of the platform constitutes acceptance of the changes.

12. Governing Law

This policy is governed by the laws of the Province of Quebec (Loi 25) and, for clients outside Quebec, PIPEDA. Any disputes will be subject to the exclusive jurisdiction of the courts in Montreal, Quebec.
